Agreement to these terms

These Terms are an agreement between you and Quantum Leap Technologies (Pty) Ltd (we, us) about your use of Metric Athlete pods, apps, website and related services (the Service). They apply to coaches, team administrators and everyone else who uses the Service. If you do not agree, do not use the Service.

1. The Service

Metric Athlete is a GPS-based sports performance platform for coaches and sports professionals. It includes:

  • GPS and motion performance tracking using Metric Athlete pods
  • Team and player management
  • Session tracking and analytics
  • Load management tools, including the Acute:Chronic Workload Ratio
  • Performance reports and data visualisation

2. User accounts

When you create and use an account:

  • You must give accurate and complete information
  • You must be at least 18 years old
  • You must keep your login details confidential and not share them
  • You are responsible for activity under your account, and must tell us immediately about unauthorised use
  • Coaches are responsible for their team data, for getting the consent needed to collect player data, and for managing team access

3. Subscriptions and payment

  • We give reasonable notice of price changes
  • Subscriptions are billed in advance on a recurring basis
  • If you do not pay, we may suspend or end the Service

4. Your content

You keep ownership of the content you upload. You allow us to use, store and process it to provide the Service.

  • We may remove content that breaks these rules
  • You are responsible for the accuracy of the data you enter, as metrics are calculated from the data provided

5. Intellectual property

The Service, including its design, features, content and brand, belongs to Quantum Leap Technologies (Pty) Ltd. We give you a limited, non-exclusive, non-transferable licence to use it, as long as you comply with these Terms.

  • You may not reverse engineer, decompile or disassemble the Service
  • You may not copy or distribute it, or create derivative works from it
  • You may not remove proprietary notices

6. Prohibited conduct

You agree not to:

  • Gain or attempt unauthorised access to the Service or related systems
  • Interfere with or disrupt the Service, or introduce malicious code
  • Use automated means to access the Service without permission
  • Use the Service illegally, impersonate anyone, or harass or harm anyone
  • Collect user information without consent
  • Sell, resell or sublicense the Service without authorisation

7. GPS and location data

Pods record GPS position and movement during sessions, and this is handled as described in our Privacy Policy.

  • GPS accuracy depends on hardware and environmental factors
  • Performance calculations are estimates based on the available data

8. Third-party services

The Service uses third-party services, including Amazon Web Services, Google Firebase, Mapbox and Vercel. Your use of them may be subject to their own terms, and we are not responsible for third-party websites we link to.

9. Medical and coaching disclaimer

The Service is not a medical device and does not give medical or professional coaching advice.

  • Metrics are for information only
  • Ask a healthcare professional about medical decisions, including injury and return to play
  • You are responsible for your training decisions
  • We do not guarantee any specific result

10. Disclaimers

To the extent the law allows, we provide the Service as is and as available, and do not promise that it will be uninterrupted, error-free or completely accurate.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, data or business opportunities. Our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these Terms limits rights that cannot be limited under the Consumer Protection Act or other applicable law.

12. Indemnity

To the extent the law allows, you agree to cover our reasonable losses and legal costs from claims caused by your breach of these Terms, your content, your violation of someone else's rights, or your negligence or wilful misconduct.

13. Ending your use

You can close your account at any time. We may suspend or close accounts that break these Terms, and may end the Service with reasonable notice.

14. Changes to these Terms

15. Governing law

These Terms are governed by the laws of South Africa, and South African courts have jurisdiction, unless the law gives you a different right. If part of these Terms cannot be enforced, the rest still applies.
